Massachusetts Must Allow Vapes for Medical Marijuana Patients

A Massachusetts Superior Court judge ordered the state to lift a ban on marijuana vaping products sold legally to medical marijuana card holders. The judge ruled that Governor Charlie Baker’s emergency regulations prohibiting the sale of vaping products to medical marijuana patients “are very likely invalid,” according to WBUR

A group representing medical marijuana patients argued that the state’s Department of Public Health overstepped its authority by instituting the ban, because marijuana regulation is under the jurisdiction of the state’s independent Cannabis Control Commission. The judge agreed. Medical marijuana patients in Massachusetts have complained that the ban left them without a viable alternative for using marijuana and that they have suffered because of it.
